The applicants submitted that they had been married in accordance with Islamic shari'a on 8 March 2008 and had three children. There were no bars to their marriage according to Islam but their marriage had never been registered by a state marriage registrar in accordance with current legislation. Accordingly, they requested that the court ratify their marriage.
In acceding to the applicants' request, the court noted that, pursuant to figure 22 of art 49(2) of Law No. 7 of 1989 on the Religious Judiciary, and art 7(3)(e) of the Compilation of Islamic Laws, no bar to the applicants' marriage existed for the purposes of Law No. 1 of 1974 on Marriage. Furthermore, the court acknowledged that the information provided by the applicants' two witnesses corroborated with the evidence submitted by the applicants.
