The prosecution submitted that the accused, on Monday 3 May 2010 at around 4.30pm, was found operating as a bookie. Specifically, that the accused had been facilitating bingo-style (toto gelap) bets to Singapore every Saturday, Sunday, Monday, Wednesday, and Thursday, providing his facilitating agents with commissions of up to 25 per cent. The prosecution submitted that this type of activity was in contravention of arts 5 and 23(1) of Aceh Qanun No. 13 of 2003 on Gambling.
Based on items seized at the time of the arrest of the accused, including a Nokia mobile phone and IDR 504,000 in cash, as well as corroborating information provided by two witnesses, the court found the accused guilty of the charges submitted by the prosecution. The court condemned the actions of the accused and sentenced him to 12 strokes of the cane.
