On appeal, the Court upheld the decision of the Bireuen Shari'a Court (lower court). The lower court had ruled as lawful a certificate of exchange, pursuant to which land the subject of a trust (wakaf) owned by a madrasah in Meunasah Tunong, was to be exchanged with land owned by Drs. Muhammad Muin (deceased), in Meunasah Teungoh, upon which a new school building was to be built.
The land and structure subject of the dispute belonged to the deceased, and had been devised lawfully to the respondents.
