This is a reference to the opinion that held to the continuing legality of mutʿa in the first century and the first half of the second century of Islam, represented by Ibn ʿAbbās and the school of Mecca, which was also held by Jaʿfar al-Ṣādiq. Hossein Modarressi cites this reference to make the case that mutʿa was considered to be lawful and established by the Qurʾān and the Prophetic Sunna in the legal legacy of the House of the Prophet.

This is a reference to a report by Jaʿfar al-Ṣādiq that indicates the importance of performing each daily prayer in its respective best time. Hossein Modarressi cites this reference to show that, although al-Ṣāḍiq and his father al-Bāqir endorsed the practice of the Prophet that permitted combining prayers (outside of special circumstances), they also emphasized the importance of performing each prayer separately during its time. This is another example of differing legal practices between the Shīʿa and other Muslims.

The applicants were married on 18 October 2013 by Tgk. H. Hanafiah, the then village imam. The second applicant's younger brother had acted as her marriage guardian (wali nikah), and the dowry (mahar) was five grams of pure gold. Due to a family dispute at the time, the marriage could not be convened at the local Office of Religious Affairs (Kantor Urusan Agama). Accordingly, the applicants requested that the court ratify their marriage retrospectively. Both applicants were eligible for marriage, the second applicant having divorced her previous husband in Lhokseumawe Shari'a Court Decision No. 232 of 2012. The applicants submitted that, while they had already attended the Banda Sakti Office of Religious Affairs to request the issuance of a marriage certificate, the office was precluded from doing so as it could not locate any information relating to their marriage.

The court acceded to the applicants' request, acknowledging that while the parties did not have proof of their marriage in the form of a marriage certificate, they had already married. Moreover, the evidence provided by the witnesses in court did not conflict with the applicants' submissions. Therefore, the applicants' submissions, pursuant to art 7(3)(e) of Indonesian Presidential Instruction No. 1 of 1991 on the Compilation of Islamic Laws, had been established and were grounded in legal reasoning.

The parties were married on 28 June 2006 by the local imam, the plaintiff's father acting as the parties' marriage guardian (wali nikah). The parties had one child. The plaintiff submitted that, since July 2006, the parties' marriage had become quarrelsome. The plaintiff submitted that the defendant had become excessively jealous of her relationship with her family, was often angry with the plaintiff for no apparent reason, and no longer carried out his responsibilities as a husband. Consequently, the parties had been separated for approximately seven years. The plaintiff maintained that her differences with the defendant were irreconcilable and, accordingly, a divorce was the only viable solution.

In the defendant's absence, the court acceded to the plaintiff's request for an irrevocable divorce (talak satu bain sughra). Acknowledging that marriage, as envisaged in art 1 of Law No. 1 of 1974 on Marriage, that being a happy family and domestic life, was no longer feasible, it granted the divorce on the grounds that the parties had been apart for more than two consecutive years, and ongoing conflict, pursuant to art 19(b) and (f) of Government Regulation No. 9 of 1975, and art 116(b) and (f) of the Compilation of Islamic Laws.
